1. Acceptance of Terms

By accessing and using Pocket Baby, you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily use Pocket Baby for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose or for any public display;
• attempt to reverse engineer any software contained in Pocket Baby;
• remove any copyright or other proprietary notations from the materials.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

3.1. Age Restrictions

You must be at least 13 years old to create an account on Pocket Baby.

If you are under 18 years old, you represent and warrant that you have your parent's or guardian's permission to use Pocket Baby and that they have reviewed and agreed to these Terms of Service.

Pocket Baby is designed for parents and guardians to track their children's development. Accounts must be created by a parent or guardian, not by children directly.

4. User Content

You retain ownership of any content you submit, post, or display on Pocket Baby. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing and improving our services.

5. Privacy

Your use of Pocket Baby is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

6. Prohibited Uses

You may not use Pocket Baby:

• In any way that violates any applicable law or regulation;
• To transmit any malicious code or viruses;
• To collect or store personal data about other users without their permission;
• To impersonate or attempt to impersonate another user or person.

Zero Tolerance Policy: We have a zero-tolerance policy for the upload of any content that depicts child sexual abuse or exploitation. We will immediately terminate the accounts of any user who uploads such content and, where required or permitted by law, report such content and user information to the appropriate law enforcement authorities and organizations such as the National Center for Missing & Exploited Children (NCMEC).

7. Termination

Your Right to Terminate: You may delete your account at any time through Settings → Privacy → Delete Account. When you request account deletion, your account will be scheduled for deletion after a 30-day grace period. During this grace period, you can cancel the deletion request. After the grace period, your account and all associated data will be permanently deleted.

Our Right to Terminate: We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

Upon termination, your right to use Pocket Baby will immediately cease. All data associated with your account will be deleted in accordance with our Privacy Policy, except where we are required to retain it by law.

8. Disclaimer

The materials on Pocket Baby are provided on an 'as is' basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8.1. Medical Disclaimer

Pocket Baby is not a medical service and does not provide medical advice.

The information provided in Pocket Baby, including developmental milestones, temperament profiles, typical milestone ages, and developmental insights, is for informational and entertainment purposes only. This information is not intended to:

• Diagnose, treat, or prevent any medical condition
• Replace professional medical advice, diagnosis, or treatment
• Be used as a substitute for consultation with qualified healthcare professionals

Always seek the advice of qualified healthcare professionals with any questions you may have regarding your child's development or health. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in Pocket Baby.

We are not liable for any medical decisions or actions taken based on information provided by Pocket Baby.

9. Limitation of Liability

In no event shall Pocket Baby or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Pocket Baby.

10. Dispute Resolution

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Dispute Resolution Process: If you have any dispute with us, you agree to first contact us at mail@nandtek.de to attempt to resolve the dispute informally. We will attempt to resolve any disputes in good faith.

If we cannot resolve a dispute informally, you may contact the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ or seek resolution through German courts.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Changes to Terms

We reserve the right to revise these terms at any time. We will notify you of material changes by posting the updated Terms of Service in the app and updating the "Last updated" date. Your continued use of Pocket Baby after such changes constitutes your acceptance of the revised terms.
